GENERAL TERMS AND CONDITIONS, RETURN AND REFUND POLICY

THE CONTRACTING PARTIES
Any contract for purchases made through the Building Fictions website will be with: Building Fictions, Lauriergracht 116W, 1016RR Amsterdam, The Netherlands.

YOUR ORDER
Building Fictions must receive payment of the whole of the price for the goods that you order before your order can be accepted, and the contract formed. Once payment has been authorized Building Fictions will confirm your order by sending an email to you at the email address you provide. The order confirmation email will include your name, the order number and the total price. Building Fictions will make every effort to ensure that payment for your order is only taken once your goods are available for download or have shipped. Acceptance of the payment by Building Fictions will bring into existence a legally binding contract between us on these terms.

AVAILABILITY OF GOODS
Building Fictions will make every effort to ensure that books are in stock before taking payment. However, if Building Fictions has insufficient stock to deliver the goods ordered by you the account user, then we will notify you as soon as possible and any sum debited by Building Fictions from your card will be re-credited to your bank or Paypal account, Building Fictions will notify you by email at the address given by you when you submitted your order. The refund will be made as soon as possible and in any event within 30 days of your order. Building Fictions will not be obliged to offer any additional compensation for disappointment suffered.

DELIVERY OF GOODS TO YOU
Building Fictions will post the goods ordered by you to the name and address you give Building Fictions at the time you make your order. Delivery will be made as soon as possible after your order is accepted and in any event within 30 days of dispatch of the order. All delivery times quoted on the website are estimates only, based on availability, normal processing and delivery companies. You will become the owner of the goods you have ordered when the goods are dispatched to you from our distribution center.

SALES TAX
All Euro prices displayed on the Building Fictions website are inclusive of VAT. Under EU VAT legislation certain book items (such as audio books and ebooks) are not eligible for reduced-rate VAT and in those cases the standard VAT rate will apply.

Rest of World. Goods sold by Building Fictions that are dispatched to addresses in the rest of the world are not subject to EU VAT, but may be subject to import duties, taxes, and charges that are levied once the package reaches your country. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from Building Fictions, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods.

LIABILITY AND RETURNS
If the goods shipped by Building Fictions are not what you ordered or are damaged or defective or if the delivery is of an incorrect quantity, Building Fictions shall have no liability to you unless you notify Building Fictions in writing to our contact address with a description of the problem within 14 days of the delivery of goods in question. If you do not receive goods that you have ordered within 30 days of the date on which they were dispatched to you, Building Fictions shall have no liability to you unless you notify Building Fictions in writing at the Building Fictions contact address of the problem within 60 days of the date on which the goods were dispatched out to you. Building Fictions shall carry no liability for losses or damages arising from the transit of the goods, the delivery service, or as a result of an incorrect delivery address provided by the customer.

If you notify a problem to Building Fictions under this condition, Building Fictions’s only obligation will be, at our own discretion, to make good on any shortage or non-delivery; to replace any goods that are damaged or defective; or to refund to you the amount paid by you for the goods in question to the original method of payment.

Prior to any monetary refund or exchange of damaged or defective goods to be issued, goods must first be returned, at customers expense, along with original invoice/ order confirmation to: ATTN: Rudy Guedj, Building Fictions, 116W Lauriergracht, 1016RR Amsterdam, The Netherlands.

Building Fictions will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to Building Fictions under this condition and Building Fictions shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under the paragraph above.

Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit Building Fictions liability to you for any death or personal injury resulting from its negligence.

Nothing in this contract creates any right which is enforceable by any person who is not a party to the contract.

FORCE MAJEURE
Building Fictions shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

INVALIDITY
If any part of these conditions is unenforceable (including any provision in which Building Fictions excludes its liability to you) the enforceability of any other part of these conditions will not be affected.

ENTIRE AGREEMENT
These terms and conditions, together with the current Building Fictions website prices, delivery details and Building Fictions contact details, set out the whole of our agreement relating to the supply of the goods to you by Building Fictions. These terms and conditions cannot be varied except in writing signed by a director of Building Fictions. In particular nothing said by any sales person on behalf of Building Fictions should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any goods offered for sale by Building Fictions. Building Fictions shall have no liability for any such representation being untrue or misleading.

GOVERNING LAW. PLACE OF JURISDICTION
These terms and conditions are subject to the law of The Netherlands.
